Reunión anual del Grupo de Trabajo de PCT con presidencia chilena

En la sede de la Organización Mundial de la Propiedad Intelectual (OMPI) en Ginebra, Suiza tuvo lugar entre el 8 y el 12 de mayo de 2017 la décima reunión anual del Grupo de Trabajo del Tratado de Cooperación en materia de Patentes (PCT), que reunió a sus 152 Estados miembros además de organizaciones intergubernamentales y no intergubernamentales en calidad de observadores. 

Esta reunión fue inaugurada por John Sandage, Director General Adjunto del Sector de Patentes y Tecnologías de la OMPI, y tuvo por objeto discutir y analizar temas relacionados con la normativa PCT y el desarrollo futuro del sistema. Le correspondió presidirla por segundo año consecutivo al Director Nacional de INAPI, Maximiliano Santa Cruz, quien fue propuesto por el Grupo de Países de América Latina y el Caribe (GRULAC) y el Grupo de Países Africano, además de Canadá y fue apoyado por la unanimidad de los Estados miembros. Asimismo, la delegación de Chile, también contó con la presencia del Jefe del Departamento PCT de INAPI, Henry Crew

Dentro de las materias que se discutieron en la reunión, se pueden destacar los servicios del PCT por internet, la formación de examinadores, la actualización de la documentación mínima contemplada para revisar en los informes de búsqueda internacional, la coordinación de la asistencia técnica en el marco del PCT y propuestas de reducciones de tasas para ciertos tipos de solicitantes como las universidades, entre otras materias.

En el mismo encuentro también se desarrolló la Trigésima sesión del Comité de Cooperación Técnica(CTC) del PCT, el cual también fue presidido por Santa Cruz, y en él se aprobó recomendar por unanimidad a la Asamblea de la Unión del PCT la designación de la Oficina de Propiedad Intelectual de Filipinas como nueva Administración encargada de la búsqueda y examen preliminar internacional (ISA/IPEA) y la prórroga de la designación de todas las Oficinas que desempeñan dicho rol y que suman actualmente 22, dentro de las cuales se incluye INAPI, para que ejerzan como Autoridad Internacional PCT por 10 años más, a contar del 01 de enero de 2018.

Biopiracy: the role of the national IP

In Peru, the National Institute for the Defense of Competition and the Protection of Intellectual Property (IDECOPI), has also the role of the president of the National Commission against Biopiracy.
Image result for macaINDECOPI working to defend the Peruvian biological resources works together with the Ministry of Foreign Affairs of Peru to defend abroad, cases of biopiracy. Up to today there are 9 pending cases of biopiracy in favour of Peru, i.e. the state has intervened in other IPO offices to stop the granting of a patent which is based on Peruvian biological products.

This year alone, there have been 7 oppositions (the other 2 were dealt with last year) filed against applications against the following patent applications:

Philippines IPO
• A composition for enhancing male libido (PH 2015000586U), referring to a pharmaceutical composition comprising the combination of extracts of aphrodisiac plants selected from Maca (Lepidium meyenii), Huanarpo Macho I (Jatropha macrantha), Huanarpo Macho II (Corynaea crassa) And Chuchuhuasi (Maytenus laevis). Said composition is used in the treatment of sexual dysfunction in men.
• A formulation for female breast and buttocks enhancement (PH 2015000587U), referring to a pharmaceutical composition comprising the combination of extracts of Aguaje (Mauritia flexuosa) and Maca (Lepidium meyenii), to enhance and favour female attributes.
People's Republic of China IPO
• (CN 201610791732), referring to a composition comprising extracts of maca (Lepidium meyenii) and cistanche, to be used as an energizer.
• (CN 201610618712), which relates to a composition comprising an extract of the shells of Plukenetia volubilis, sacha inchi, for the treatment of hypertension and a method of extraction.
• "Anti-inflammatory and anti-oxidant composition and related method of use" (CN 104066434), on the use of tara as anti-oxidant and anti-inflammatory.
Taiwan, opposition to the patent application
• "Anti-inflammatory and anti-oxidant composition and related method of use" (TW 201340975) - related to the use of tara as anti-inflammatory and anti-oxidant.

Hong Kong IPO
• Anti-inflammatory and anti-oxidant composition and related method of use "(HK 1199197) - related to the use of tara as anti-inflammatory and anti-oxidant.

The National Commission reports that since its creation in May 2004, it has identified 30 cases of biopiracy in the world related to Peruvian biological resources in the patent system: 18 have been resolved favourably for Peru; 9 pending; 1 registration which is suspended; and 2 which were granted (but before the creation of the Commission).

Collective marks and it benefits

From Peru we heard that the National IPO (INDECOPI) and its regional office in Huanuco have been working non-stop with communities in the said region. They are assisting farmers and produces in the region throughout the process of acquiring collective marks. This support has been provided free of charge and has lasted several month --from July until November 2016.

Image result for BANANITOS peruThis month INDECOPI’s Board of Directors’ chairman, gave the certificates: 15 collective marks and one mark for a product. They were granted to associations producing cocoa, coffee, banana, rice and flowers which are located in the town of Tingo María, Huánuco.

INDECOPI is said to promote associations among producers trying to unify them and to help them to have a standardization of the quality of products and so, improving the image and economy of these entrepreneurs. The collective mark registered were all trade names and now this collective mark will belong to different farmers/companies but the use of the mark will be under the control of a proprietor which is an association that is legally established.

The aim of having a collective mark for small business and as in this case, farmers, is to promote the unification and harmonization of products among them. Moreover, they will jointly face the market and compete in the market having a single strategy.
